Significant decrease in the number of Special Cases (SPCs) involving Pre-Proclamation Controversies and Petitions for Annulment of Proclamation were filed with the Commission on Elections (COMELEC) in relation to the first nationwide automated elections on
Pre-proclamation controversy refers to the proceedings of the board of canvassers which may be raised by any candidate or any registered political party or coalition of political parties, or by any accredited and participating partylist group, before the board or directly with the Commission. COMELEC Resolution No. 8804 restricts the filing of pre-proclamation controversy to only two issues: (a) illegal composition of the Board of Canvassers (BOC); and (b) Illegal proceedings of the BOC (Com. Res. 8804, Rule 3, section 1).
If the illegality of the proceedings of the BOC is discovered after the official proclamation of the supposed proclamation, a petition to annul the proclamation may be filed before the COMELEC within ten (10) days after the day of proclamation (Com. Res. 8804, Rule 4, sec. 6).
